Mental Health Discrimination

mental health

Many people think a physical or sensory impairment is a disability, whilst mental health problems are often disregarded. However, if you have a mental health condition that has a serious impact on your day-to-day life over a long period, then your mental health might be considered a ‘disability’.

Legislation preventing discrimination on the grounds of disability applies to all employers in the UK, and is there to protect employees from being discriminated against because of their physical, sensory, and/or mental health impairments. You have the right not to be discriminated against at work because of your mental health condition, see below what you can do and how we can help.

What Can You Do?

Many people with a mental health condition do not consider themselves as having a ‘disability’. There are different types of mental health conditions, which can have a serious impact on your day-to-day life over a period of time, including:

  • Depression
  • Bipolar Disorder
  • Obsessive Compulsive Disorder
  • Schizophrenia

If the effects of your mental health condition have been disrupting your everyday life over a long time, and you have been discriminated against, harassed, unfairly treated, or even dismissed because of your condition then you may be entitled to take action

Disability Discrimination law differ slightly between Northern Ireland and the UK. Wherever you are based, we will be able to advise you on this.
