“Help! I’ve been told to find a new job. What should I do?”

If your boss has told you to find a new job, whether through redundancy or for another reason, there are a number of things to think about.

Have they offered you money to leave?

NO

If they haven’t offered you money to leave, give us a call. We might be able to help you get such a payment in return for you agreeing not to take your employer to the employment tribunal.

As you may know, this is called a ‘compromise agreement’ in Northern Ireland, or a ‘settlement agreement’ elsewhere in the UK.

YES

If they have offered you money to leave, you may not be aware that you don’t have to accept the first amount they offer you. We could help you renegotiate the terms of the agreement so you end up with a better deal.

As well as achieving the best payment for you, we could help ensure your employer writes you a good reference, and/or we could work to ease any restrictive covenants they are attempting to place upon you. (A restrictive covenant is a clause that restricts you from doing things like working for a competitor within a certain period of time).

Note that, for the agreement to be legal, you MUST take the advice of an independent specialist solicitor like us. Don’t worry, your employer will usually pay.

Have you been dismissed unfairly?

NO

If you were sacked because of your poor conduct or lack of capability to do the job well, it probably doesn’t count as unfair dismissal. Also, it’s not unfair dismissal if you lost your job through redundancy (although you may still be entitled to a payment).

YES

If your employer dismissed you for an unfair reason, or they failed to follow the proper legal process, you might be entitled to bring a claim against them for unfair dismissal.

For example, it’s illegal if you lost your job because of pregnancy or leave due to family reasons such as maternity/paternity or adoption, or due to your trade union activities, or for claiming your rights relating to pay and working hours.
